Introduction
overview
In 2023, the Village contracted with Baxter & Woodman to do the engineering design and construction management for the North Pump Station Emergency Generator Project. Baxter & Woodman has had to perform additional construction management beyond the originally anticipated duration of the project due to delays by the contractor. The additional work for overseeing this project amounts to $28,900 and adjusts the task order from $105,000 to $133,900. These additional costs are being deducted from the money due to the contractor as liquidated damages since the project is beyond its completion date.

Prior Board Action
The Board has taken the following prior actions:
• On December 9, 2025, the Board approved the Renewal of the Master Agreement with Baxter & Woodman, Inc. for Professional Engineering Services in 2026 (RES 25-356).
• On December 2, 2024, the Board approved the first one-year renewal of the Master Agreement with Baxter& Woodman, Inc. for Professional Engineering Services (RES 24-389).
• On July 20, 2024, the Village Board approved a Contract with William T. Connelly, Inc., d/b/a Connelly Electric Co. for Project 24-12, North Pumping Station Generator Addition, in an amount not to exceed $420,000 (RES 24-221).
• On July 31, 2023, the Village Board approved a Task Order for Professional Engineering Services with Baxter & Woodman, Inc. for Design and Construction Engineering for the North Pump Station Emergency Generator Project 24-12, in an Amount Not to Exceed $105,000 (RES 23-235).
• On September 20, 2021, the Village Board approved a Three-Year Master Agreement with Baxter& Woodman, Inc. for Professional Engineering Services with an option to renew the agreement for up to two additional one-year periods (RES 21-223).
Background
In 2023, the Village entered into a Task Order with Baxter & Woodman to provide the design and construction engineering for the North Pump Station Emergency Generator Project.
Construction of the project by Connelly Electric has exceeded the approved construction schedule, resulting in additional costs to oversee the project by Baxter & Woodman. The Village will be enforcing liquidated damages to the contractor, Connelly Construction, in the amount of $28,900 to cover these additional costs, so there is no net fiscal impact to this amendment. Connelly Electric has agreed to be charged these liquidated damages since the work has continued past the project’s completion date. Work on the project is substantially complete except for final punch list work and project closeout.
Timing Considerations
There are no specific timing considerations associated with this item. The consultant has already incurred the additional expenses associated with overseeing the construction of this project, which is substantially complete.
Financial Impact
There is no fiscal impact associated with this item since the additional costs for the $28,900 needed for this amendment are being deducted from money due to the construction contractor, Connelly Electric, as liquidated damages.
