Introduction
overview
Sidewalk easements are necessary to construct sidewalk and alley improvements in the Hemingway Business District as the property line extends into the sidewalk or alley areas at certain locations. There are five properties where easements are required and some of the property owners have requested compensation. This Resolution authorizes the Village to acquire the required easements and authorizes the Village Manager to execute the associated documents for obtaining these easements.

Background
The proposed Oak Park Avenue streetscape project includes replacing the sidewalk up to the building face along Oak Park Avenue in the Hemingway Business District. On the west side of Oak Park Avenue, from North Boulevard to Lake Street, the buildings are set back approximately four feet from the property line. There are no existing sidewalk easements recorded against these five private properties.
The Village has been working with the property owners to acquire sidewalk easements so that the Village can replace the sidewalk on private property. The Village has been requesting to obtain permanent easements to allow for the construction of the project and to have a permanent easement in place, which allows the public to use the sidewalk and for the Village to maintain the sidewalk. The Village has been requesting that property owners donate the sidewalk easements since the Village will be replacing the sidewalks at no cost to the property owners. To date, at least two of the properties have agreed to donate either a temporary construction easement or permanent sidewalk easements.
This Resolution approves the acquisition of a temporary construction easement at 113 N. Oak Park Avenue and permanent public sidewalk easements at 101-107 N. Oak Park Avenue, 109-111 N. Oak Park Avenue, 115 N. Oak Park Avenue, and 129-151 N. Oak Park Avenue needed for the Oak Park Avenue Streetscape Project on the west side of Oak Park Avenue between North Boulevard and Lake Street. In order to comply with Federal laws, the Village is required to fairly compensate property owners based on the fair market value of the easement areas for any easements not donated.
Timing Considerations
Adoption at this time will allow for the project to advance on a suitable timeline.
Budget Impact
There are available funds to acquire the necessary easements in the FY2025 Budget in the Capital Improvement Fund, Public Works - Engineering, Streetscaping account no. 3095-43780-101-570959.
