The Zoning Board of Appeals held a public hearing on a special use application filed by the Applicant, Adam Wolf - Real PT, LLC dba The Movement Guild, pursuant to Section 8.3 ("Table 8-1: Use Matrix”) of the Oak Park Zoning Ordinance to operate a physical therapy clinic at the property located at 221 Harrison Street.  Staff concurs with the recommendation.

Background

The Subject Property is located on the south side of Harrison Street between Lombard Avenue and Highland Avenue in the HS Harrison Street Zoning District. The Subject Property is surrounded by the properties zoned within the HS Harrison Street Zoning District and the following uses: to the north, Harrison Street and live/work units and studios/retail properties; to the south, residential dwelling units; to the east, commercial/retail properties; and to the west, commercial/retail properties. The Applicant plans to operate a physical therapy clinic within the existing CrossFit Spero workout facility at 221 Harrison Street. The physical therapy clinic would be operated within an existing tenant space and would supports the HS Harrison Street Zoning District by drawing in clients who would patronize businesses in the area.

Citizen Advisory Commission Action

The Oak Park Zoning Ordinance currently lists Physical Therapy Clinics as a permitted special use in the HS-Harrison Street zoning district. A special use application requires a public hearing before the Zoning Board of Appeals, or when applicable, the Plan Commission, where any member of the public, in particular those from the immediate neighborhood, can attend and make their concerns or support known as this use is not a typical use within this arts district commercial corridor.

The Zoning Board of Appeals held a public hearing on May 5, 2021 <https://www.oak-park.us/your-government/citizen-commissions/commission-tv>.  No one testified in opposition to the requested special use permit application. The Zoning Board of Appeals ratified their findings of fact with two standard conditions by a 5-0 vote in favor of the application at their May 5, 2021 meeting.  The two standard conditions are relative to the special use permit being limited to the approved use that is operated by the applicant only and if the condition is not fulfilled it will be deemed in violation.
