A Resolution Approving an Electrical Utility Easement Agreement with the Frank Lloyd Wright Trust and Authorizing its Execution

Overview
Overview
The Frank Lloyd Wright Trust (FLW Trust) is proposing the construction of a new building at 929 Chicago Avenue. This project would require relocating the Village’s existing electrical service for the street lighting system into a new easement at the adjacent property at 925 Chicago Avenue. The FLW Trust is granting the Village an easement for these electrical utilities at 925 Chicago Ave. The FLW Trust will perform the work to relocate the Village’s utilities into the new easement area at their cost.

Recommendation
Adopt the Resolution.
Background
The Village has existing underground electrical cables and conduit which provide power to the Village’s street lighting system in an existing shared easement with AT&T and Comcast. This is located at the 929 Chicago Avenue property owned by Frank Lloyd Wright Trust. These electrical utilities were installed in 2017 at the Village’s cost at the request of the FLW Trust to remove older aerial electrical and AT&T cables that ran through the large Gingko tree in the FLW Home and Studio’s courtyard.
The FLW Trust is now proposing to construct a new building at this 929 Chicago Ave. property which conflicts with the existing utility easement. The Village has been working with the FLW Trust to relocate these utilities to a new proposed shared easement at the adjacent 925 Chicago Avenue property also owned by the FLW Trust.
In this proposed easement, the FLW Trust will pay their contractor to install new underground electrical cable and conduit that meet Village requirements and connect this new electrical service to the Village’s street lighting system. They will also pay to relocate Comcast and AT&T from the old easement into this new shared easement.
The easement agreement grants the Village easement rights for these underground electrical facilities. The Village will own and maintain the proposed electrical work following its completion.
Fiscal Impact
There is no fiscal impact to accepting the new electrical utility easement at 925 Chicago Avenue as the FLW Trust will pay costs associated with relocating the existing underground electrical service into this new easement and for recording the easement.
