Introduction

The Public Works Department Water & Sewer Division, on occasion, require the assistance of an outside water and sewer contractor to make a repair when in-house staff are unable to make repairs due to competing priorities or complexity of the required repair. Due to a complex repair on February 4, 2026, the Village had to contract a repair with Cerniglia Co. that utilized more than half of the existing contract amount available for the remainder of the year. Public Works staff recommend increasing the not to exceed amount to $75,000 because on average the department has contracted repairs annually that total between $70,000 and $80,000 with Cerniglia Co.

Background
The Public Works Department Water & Sewer Division typically makes repairs to the water distribution and sewer collection systems utilizing in-house staff and expertise. On occasions when in-house staff is unable to make repairs, for instance when crews are performing snow removal operations, lack the necessary equipment to perform such repairs, or multiple repairs are required simultaneously, an outside water and sewer contractor is called in to make the repair.
On February 4, 2026, Water & Sewer Division staff were made aware of a 15” sewer main that was hit by an IDOT contractor following an inaccurate fulfillment of a JULIE request. The urgent nature of, complexity, and depth at which the repair was needed required staff to utilize the existing contract with Cerniglia Co. to complete. This repair alone used more than half of the existing contract amount with Cerniglia Co., at $20,928.24, requiring an immediate follow-up with a budget amendment to ensure that these services are still available, should the need arise, throughout the remainder of the year. Public Works staff chose to increase the contract amount to $75,000 because on average the department has contracted repairs annually with Cerniglia Co. that total between $70,000 and $80,000.
Timing Considerations
Approving this resolution in a timely fashion, without delay, allows for the continued contracting of water and sewer emergency services should time and manpower necessitate.
Financial Impact
There are sufficient unencumbered funds within the Water and Sewer Fund, External Support, account nos. 5040-43730-777-530667 and 5040-43750-781-530667.
Operations Impact
Approving this resolution allows Village staff to have the available resources should the Water and Sewer Division experience competing priorities or a lack of expertise to complete a repair in a timely or safe fashion.

Staff Recommendation
Approve the resolution allowing for an increase to the not to exceed amount for the renewal of the Independent Contractor Agreement with Cerniglia Co.
Advantages:
• The proposed resolution provides for the necessary contractor assistance with water and sewer emergency repairs. Without this assistance, the Water and Sewer Division could potentially experience a delay in making repairs should the division’s staff experience competing priorities.
• Completing water main repairs in a timely fashion minimizes water loss.
Disadvantages:
• There are no disadvantages to completing water and sewer repairs in a timely and safe fashion.
Alternatives
The Village Board could delay action to gain additional information.
Advantages:
• The Village Board would receive the additional information requested to make a more informed decision.
Disadvantages:
• The Water and Sewer Division could be unable to perform water and sewer emergency repairs should a repair require additional equipment, resources or expertise.
