Referral of a Zoning Ordinance map amendment application to change the zoning of the property located at 417 N. Marion Street from B-1/B-2 General Business District to R-6 Multiple-Family District in order to convert the use of the frame building on the property from a graphics design studio to a single-family residence.

Staff Recommendation
Staff supports the referral of this map amendment application to the Zoning Board of Appeals for the purpose of holding a public hearing thereon pursuant to Section 2.2.2 (E) of the Zoning Ordinance.
Fiscal Impact
Village cost for public notice and updating the existing Zoning Map to reflect the proposed amendment.
Background
The Subject Property is located south of Chicago Avenue on Marion Street in a Zoning District classified as B-1/B-2 General District. The property is improved with a single-story frame building with basement. The area immediately north of the Subject Property is Zoned B-1/B-2 General Business and developed with business uses. The area south of the property is Zoned R-6 Multiple-Family and developed with multiple-family dwellings, a single-family residence and two-family dwellings. Village records indicate that the Village Board approved a rezoning petition (map amendment) to change the zoning of the property from a residential to a business district on November 19, 1973. Prior to the rezoning, the property was used as a single-family residence.
Alternatives
The Village Board may refer this application to any appointed or elected commission or committee, including but not limited to the Plan Commission, for the purpose of holding a public hearing thereon pursuant to Section 2.2.5 of the Zoning Ordinance.

Anticipated Future Actions/Commitments
The Zoning Board of Appeals, following the hearing, shall transmit to the Village Board a written report of its findings and the President and Board of Trustees may pass the proposed amendment with or without change, or may reject it, or may refer it back to the hearing commission or committee for further consideration.
