Background
The Oak Park Police Department has been revising the OPPD’s Prohibition Against Bias Based Policing Policy to include restrictions of traffic stops related to equipment and other non-safety violations. This action is aligned with one of the recommendations contained in the Berry Dunn Public Safety Assessment.
The Motion by Trustee Eder and Trustee Enyia directs staff, the Citizens Police Oversight Commission (CPOC), and Pivot Consulting Group to draft a policy within 60 days for Board enactment.
Timing Considerations
The Village has not yet entered into a contract with a consultant for this work. Negotiating and finalizing a contract, and subsequent Board approval may require additional time.
Financial Impact
There are costs associated with retaining a consultant to support the review process. Funds have not been budgeted for this review. A subsequent budget amendment may follow once a contract is finalized with Pivot Consulting Group.
Operations Impact
If directed, staff will work with the Citizens Police Oversight Committee to recommend a policy and bring forth such policy to the Board within 60 days. Staff anticipates this will take between 20 and 40 hours among the Police, DEI, and Legal Departments.
DEI Impact
Pretextual stops can create an opportunity for bias-based contact. Bias-based contact has a disproportionate impact on minority communities.
Community Input
The Citizens Police Oversight Committee will provide community feedback with regard to the development of policy recommendations. Other commissions may provide additional community input as directed.
Staff Recommendation
Should the Village Board adopt the motion, staff recommend the OPPD present a draft of the revised Prohibition Against Bias-Based Policing Policy to the Citizens Police Oversight Committee for review as a part of the process. CPOC can provide a community-based lens with regard to the policy with or without the support of a consultant. Following review, the OPPD will finalize a revised recommendation and bring it forward to the Village Board for discussion and adoption within 60 days of the motion.
Alternatives
The policy can be reviewed by the CPOC with or without the support of a consultant.
Anticipated Future Actions
If approved, staff will begin preparing the requested policy within the directed time window with the requested partners.
