LMC Oak Park Holdings, LLC, Applicant, requests a variation from Section 3.9.3 (F) (2) (e) of the Transit-Related Retail Overlay District use restrictions, which section prohibits office uses from locating on the ground floor of buildings within 50 feet of a street line, to allow a general office use (The Emerson Leasing Office) on the ground floor of the building within 50 feet of a street line at 1116 Lake Street.

Background

The applicant is seeking permission to allow The Emerson Leasing Office, a general office use, to temporarily occupy the space located at 1116 Lake Street, a tenant space located in the B-4 Downtown Business District and a Transit-Related Retail Overlay District (TRROD), wherein the TRROD does not allow general office uses on the ground floor or at grade within 50 feet of a street line. The Emerson Leasing Office would be a temporary (four-month) use for the Emerson, a new 270 unit mixed-use building located at 1132 and 1135 Westgate.

 

The Village Board may vary the regulations of this Zoning Ordinance related to the use of land, buildings or structures by ordinance, provided the ZBA has conducted a public hearing in accordance with section 2.2.5 of this Zoning Ordinance and has made findings of fact in accordance with the standards set forth in Section 2.2.4.

 

Alternatives

Deny the requested variance, which would not allow the proposed leasing office at 1116 Lake Street on the ground floor and within 50 feet of the street line.  A 2/3 vote of the Village Board is required to deny this recommendation.

Citizen Advisory Commission Action

The ZBAs held a public hearing on May 3, 2017. The Zoning Board of Appeals ratified their findings of fact on May 3, 2017. The ZBA is transmitting a written report of their findings and recommendation to the President and Board of Appeals as incorporated, which was approved by the ZBA by a vote of six (6) to none (0).
