The Village Board approved an Ordinance granting a special use permit to construct a six (6) unit townhome development at 427 Madison Street on June 18, 2024.
Background
By Ordinance 24-129, dated June 18, 2024, the Village Board granted the special use permit to the Applicant. Pursuant to Article 14.2 (G) (Extension) of the Oak Park Zoning Ordinance, a special use approval tied to new construction expires within one year of the date of approval, if a building permit has not been issued. According to the special use approval, the Applicant was required to receive a building permit by June 18, 2025. However, the Applicant on June 12, 2025, filed for an extension, before the special use permit expiration date. The Applicant requested a six (6) month extension to obtain a building permit no later than December 18, 2025.This is a core service priority.

The Applicant has requested a six (6) month extension to submit for a building permit that would expire on December 18, 2025. If the extension is not received the current special use will become null and void.

Community Input
The Zoning Board of Appeal held a public hearing on June 5, 2024. No one testified in opposition to the requested special use permit. However, Anna Johnson submitted a letter to the ZBA requesting that the proposed townhome development undergo an architectural review by the HPC or Architectural Review Community. The Zoning Board of Appeals ratified their finding of fact by a 4-0 vote on June 5, 2024. Staff Recommendation
Staff recommends approval of the Ordinance.
Advantages:
* This action allows the Applicant time to amend plans for the permitting process due to the current economic climate and increased construction material costs.
* The completion of the development would increase the availability of townhomes and contribute to the diversity of housing in Oak Park.
Disadvantages:
* The approved special use permit would expire without the requested extension, thereby retaining a vacant lot.
Alternatives
Alternative 1:
The Board can choose not to adopt the Ordinance and deny the extension.

* This action can create a potential development opportunity.

Anticipated Future Actions
There are no anticipated future actions for this item for the Board. If the extension is approved, regular licensing and inspections (e.g. business license, occupancy permit, building permits for construction work) would be coordinated between stall and the applicant as next steps.
