The Ordinance creates a new bring-your-own (“BYO”) Restaurant Class B-6 liquor license classification. Upon adoption, the Local Liquor Control Commissioner may receive applications for such licenses from restaurants located in the Village that do not currently hold another Restaurant Class B liquor license.

Background
At its meeting of April 24, 2018, the Liquor Control Review Board (“LCRB”) adopted a motion to to recommend the creation of a new BYO Restaurant Class B-6 liquor license classification. The Ordinance as drafted contains the requirements for such a license pursuant to the LCRB’s motion.
Those requirements include the following: (1) BYO is limited to beer and wine; (2) the insurance required by section 3-4-6 of the Code will also be required for BYO licensees; (3) BYO consumption is only permitted between 12:00 p.m. and 11:00 p.m.; (4) no fees may be chared by a licensee for allowing BYO consumption; (5) employees who serve customers must successfully complete BASSET training; (6) a BASSET trained manager or employee 21 years of age or older must be present at the established while BYO consumption is permitted; (7) a BYO establishment must ensure that no persons under 21 years of age are in possession of BYO beer and wine or consume BYO beer and wine; and (8) an annual $500 license fee.
The Ordinance is modeled in part on the City of Berwyn’s BYO liquor license classification set forth in Berwyn’s City Code. If the Ordinance is adopted, the Local Liquor Control Commissioner may begin to receive applications for a BYO license from restaurants in the Village that do not currently hold a Restaurant Class B liquor license.
