Overview
Per the Metropolitan Water Reclamation District of Greater Chicago’s (MWRDGC) requirements and Village policies, a sewer easement is required in order for the development at 6033-6037 North Avenue to own and operate a private sewer in the public right-of-way of Humphrey Avenue running parallel to the Humphrey right-of-way. The sewer easement allows for this sewer to be owned and maintained by the private property at their cost up until its point of connection to the Village’s sewer on North Avenue.

Fiscal Impact
There is no fiscal impact to granting the sewer easement. The sewer will be owned and maintained by the private property owner at their cost.
Background
Per the approved Plan Development Ordinance, approved MWRDGC permit, and approved permit plans, the development at 6033-6037 North Avenue located at the southeast corner of Humphrey Avenue and North Avenue installed a sewer serving the property in the Humphrey Avenue right-of-way (ROW) running parallel to the Humphrey ROW until it reaches the connection to the Villages sewer main on North Avenue. Per MWRDGC’s requirements and in accordance with Village policies, private sewers running parallel to the property line in the ROW require an easement in order to clearly establish ownership and maintenance responsibilities since private sewers typically run perpendicular to the property line.
Now that construction is substantially completed on this development, the developer was required to provide an as-built survey of the proposed easement area and have this easement recorded prior to the Village granting final occupancy permits. The sewer easement agreement grants an easement for the property to own the sewer in the Humphrey ROW and maintain the sewer up until the sewer’s connection to the Village’s sewer on North Avenue.

The alternative to this recommendation could be to delay action to gain additional information.

At the October 21, 2019 regular meeting the Village Board approved an Ordinance Granting a Special Use Permit for a Major Planned Development Containing Three Four-Story Multiple Family Buildings at the Property Located at 6033 North Avenue.
