On November 1, 2021, the Village Board adopted an ordinance regulating short-term rentals in the Village which is codified as Article 40 (“Short-Term Rentals”) of Chapter 8 (“Business Licensing”) of the Oak Park Village Code. Staff is recommending that the Village Code be amended to provide a definition of short-term rentals.

Background

On November 1, 2021, the Village Board adopted an ordinance regulating short-term rentals in the Village which is codified as Article 40 (“Short-Term Rentals”) of Chapter 8 (“Business Licensing”) of the Oak Park Village Code. The ordinance was adopted in the interest of public health, safety, and the welfare of the residents of the Village as there was a need to regulate short-term rentals to alleviate any potential adverse impact on the community.

 

On September 6, 2022, the Village Board amended the short-term rental ordinance within Section 8-40-1 (“Definitions”) and Section 8-40-5 (“Standards”) to provide a definition of a short-term rental period.

 

To date, the Village has received 90 short-term rental applications of which 72 have been licensed, 12 are pending re-inspection, 3 are pending inspection, and 3 have withdrawn their application. There are 124 properties that were previously identified as potential short-term rental locations of which 75 have removed their rental listings and 49 are identified as not being available but listed.

 

After the adoption of the ordinances referenced above, Village staff have received questions regarding what is included in the definition of short-term rentals. The proposed ordinance provides further clarification on the definition.

Previous Board Action

On September 6, 2022, the Village Board amended the short-term rental ordinance within Section 8-40-1 (“Definitions”) and Section 8-40-5 (“Standards”) to provide a definition of a short-term rental period.

 

On November 1, 2021, the Village Board adopted an ordinance regulating short-term rentals in the Village which is codified as Article 40 (“Short-Term Rentals”) of Chapter 8 (“Business Licensing”) of the Oak Park Village Code.

 

On September 19, 2016, the Village Board adopted Ordinance 16-109 (“An Ordinance Amending Chapter 23A (“Taxes”), Article 4 (“Hotel/Motel Tax”) of the Oak Park Village Code to Include Transient Occupancy Rental Units”). It should be noted that at this time, the Village Board opted not to license short-term rentals.

 

On this same date, the Village Board adopted Resolution 16-305 (“A Resolution Approving a Voluntary Collection Agreement with Village of Oak Park Transient Occupancy Tax with Airbnb, Inc. and Authorizing its Execution”).
