Overview
In response to the COVID-19 pandemic, under the emergency declaration per Resolution 20-43, which expired on June 15, 2021, the Village Manager was authorized to enter into Temporary License Agreements to allow local businesses to utilize parking spaces for outdoor dining/drinking without a fee. The Village Manager executed the first Temporary License Agreement with The Beer Shop that expired on July 1, 2021. The Village Board approved two extensions (Resolution 21-165 and Resolution 21-255) to the Temporary License Agreement, allowing The Beer Shop utilization of three public parking spaces in Public Lot #10, without charging a fee. The most recent Village Board-approved extension runs until March 31, 2022. The Beer Shop has requested a fourth Temporary License Agreement, a third extension, to continue their free utilization of three public parking spaces in Public Lot #10.
Currently, staff is recommending approval of the requested Temporary License Agreement, continuing the past practice of waiving the required parking space fee. The Village’s outdoor dining program, by ordinance, normally extends through November 30th of each year, staff is recommending that the Temporary License Agreement, if extended, go through November 30, 2022.

Fiscal Impact
By Village Ordinance, Section 7-8-1, the cost charged for daily utilization of one public parking stall is $20 per day. Execution of the Village Manager’s first Temporary License Agreement with The Beer Shop waived the required parking fee. Due to the Covid-19 emergency, the Village waived all outdoor license fees for the 2021 season. The Beer Shop’s utilization of the three public parking spaces in Lot #10, by Village Board action, has been a part of that fee waiver. By the end of March 2022, the Beer shop will have had utilization of three spaces for 504 days, or a total of 1,512 parking space days. This free utilization, using the lowest daily fee required by Village Ordinance for the use of public parking spaces, means the Village has already waived $30,240 in parking fees for The Beer Shop. If parking space fees were again waived through November 30, 2022, the total parking space days would equal 2,244 and the grand total of the Village’s fee waiver, since The Beer Shop began using the parking spaces, would be $44,880.

The Village Manager executed the first Temporary License Agreement with The Beer Shop that expired on July 1, 2021.
Starting in the spring of 2021, the Village worked with numerous businesses to set up outdoor dining/drinking locations in Village-owned parking spaces. Again, due to the emergency declaration in effect at the time, the Village Manager was authorized to sign these temporary license agreements.
On June 19, 2021, the Village Board approved Resolution 21-165 extending The Beer Shop’s initial utilization of the three public parking spaces in Public Lot #10, without charging a fee, until October 31, 2021. On November 1, 2021, the Village Board approved Resolution 21-255, again extending The Beer Shop’s utilization of four public parking spaces in Public Parking Lot #10, without charging a fee, until March 31, 2022.
The Beer Shop has requested a fourth Temporary License Agreement, a third extension, to continue their free utilization of three public parking spaces in Public Lot #10.
Village staff understands the importance of outdoor dining/drinking as local businesses work to recover from the COVID-19 emergency. On March 31, 2022, The Beer Shop will have benefited from the free utilization of three public parking spaces in Public Parking Lot #10 for 504 days, totaling 1512 total parking space days. The Beer Shop is asking to extend the free utilization of the parking spaces. If extended to November 30, 2022, that would add an additional 244 days, totaling 732 total parking space days, bringing the grand total number of total parking space days utilized by The Beer Shop, from the start of this arrangement to November 30, 2022, to 2,244 total parking space days. Staff is recommending the continuation of the waiver of said parking space fees through November 30, 2022.

Alternatives
Do not approve the ordinance or approve the ordinance, but do not waive the required parking space fee. If the fee waiver is not approved, the cost of each parking space would be $20 per day.
