On February 4, 2019 the Village Board approved two motions, the first  to concur with the Farmers’ Market Commission’s recommendation to amend Chapter 18 (“Peddlers and Solicitors”), Article 2 (“Farmers’ Market”) of the Oak Park Vilalge Code to remove the requirement for Fish Vendors to be from the five (5) state region of Illinois, Iowa, Wisconsin, Michigan and/or Indiana and the second  motion to create a food service vendor category of permitted vendor related to home food production, processing or preparation and directed staff to prepare the necessary ordinance.

Background

FOOD SERVICE VENDOR BACKGROUND:

 

At the November 14, 2018 Farmers’ Market Commission meeting (minutes attached), commissioner Dina Ross inquired about allowing a knife sharpening business to participate at the farmers’ market. The current enabling Village ordinance language under Chapter 18 “Peddlers and Solicitors” Article 2 “Farmers’ Market” current prohibits this category of vendor/permittee. There was sufficient interest from the Farmers’ Market Commission members to continue discussion on this inquiry until the next regularly scheduled Farmers’ Market commission meeting.

 

At the January 9, 2019 Farmers’ Market Commission meeting (draft minutes attached) the Farmers’ Market Commission voted unanimously to submit a recommendation to the Village Board to direct staff to amend the Farmers’ Market Ordinance to create a “Service Provider” category of permittee/vendor related to home food production, processing or preparation.

FISH IN FIVE (5) STATE REGION BACKGROUND:

 

The Farmers’ Market Commission voted at their November 14, 2018 meeting (minutes attached) to submit a recommendation to the Village Board to amend Chapter 18 “Peddlers and Solicitors” Article 2 “Farmers’ Market” to allow for the sale of frozen fish that was caught/captured outside the five state region of Illinois, Iowa, Wisconsin, Michigan and/or Indiana. The Farmers’ Market Commission is requesting that the Village Board direct staff to prepare the necessary ordinance in support of their recommendation.

 

The Farmers’ Market Commission and Farmers’ Market Manager have identified that customers are interested in the sale of fish at the Oak Park Farmers’ Market. The Farmers’ Market Manager has searched for fish vendors from the five state region of Illinois, Iowa, Wisconsin, Michigan and/or Indiana and found no available fish vendors. In order to attract a fish vendor to apply for the Farmers’ Market, the Farmers’ Market Commission is recommending the ordinance be amended. The Farmers’ Market Commission and staff have identified at least one fish vendor that uses sustainable practices and is family owned that is interested in applying to sell frozen fish at the Farmers’ Market, this fish vendor is located in Alaska. Amending the ordinance would allow the Farmers’ Market Manager to pursue a fish vendor to sell at the farmers’ market.

Previous Board Action

FROZEN FISH

 

In 2004 the Village ordinance was amended to add “frozen fish” to the products that could be sold at the farmers’ market. In 2016 the Village ordinance was amended to remove the limitations on the number of “frozen meat, poultry or fish” vendors that were allowed to participate at the market. The previous limitation was up to two (2) vendors per market season.

 

FOOD SERVICE VENDOR

 

On February 1, 2010 the Village Board voted to amend the Farmers’ Market ordinance by removing “Local Retailer of Farm Products”.  This vendor category was very similar in definition to the current “Food Service Vendor” category of permitted vendor being recommended by the current Farmers’ Market Commission.  Attached are two documents providing detail on the 2010 agenda item.
