Overview
Since 2005 the Village has entered into license agreements for the use of Lot #116 at the northeast corner of Oak Park Avenue and Madison Street. Currently the Village has a license agreement with Fenwick High School for student permit parking. This agreement will expire on July 31, 2019.

Fiscal Impact
The annual Parking Fund budget provides for the revenues anticipated to be received from the agreement. Currently Village Code sets the rate for student permits at $240 per permit if Fenwick High School administers the permit sales program.
Background
On May 15, 2017 the Village Board approved a one year license Agreement with Fenwick High School for use of Lot #116 at the Northeast corner of Oak Park Avenue and Madison Street and lot #SB5 on the north side of South Boulevard between Wesley and East Avenues
On May 5, 2014 the Village Board approved a three year license Agreement with Fenwick High School for use of Lot #116 at the Northeast corner of Oak Park Avenue and Madison Street and lot #SB5 on the north side of South Boulevard between Wesley and East Avenues.
In January 2005, the Village acquired the 125 space parking lot at the northeast corner of Oak Park Avenue and Madison as part of the Foley-Rice Business Retention Agreement and Foley-Rice used the lot through March of 2007 for car storage during the remodeling of the dealership.
Subsequently, the Village approved use of the Lot by Fenwick High School from March of 2007 through January 2008 for construction worker parking during the construction of an addition to the High School. Since this time, the Village has approved multiple agreements for shared use of the lot, now referred to a parking lot #116 as follows:
• Four consecutive agreements with Fenwick High School use of 100 spaces in the lot for student parking subject to applicable parking permit fees. The most recent agreement expires in July of 2017.
• Four consecutive agreements with Dombrowski Christmas Tree Farm for use of 25 spaces. The most recent agreement expired in December of 2016.
• One agreement with the Oak Park Arms for use of 25 spaces in the lot for employee parking subject to applicable parking permit fees. No renewal agreements have been requested at this time.
To date, the shared use of the lot by multiple users has been successful. The current users understand that the property is being marketed for redevelopment and all agreements provide a thirty day termination clause in the event of an economic development opportunity at the site.
The parking permit fee is established under Section 15-3-18 J of the Village Code at $240 per year subject to Fenwick’s administration of the permit sales. The Village will determine the form of permit to be displayed by Fenwick students. The parking permit issued by the Village shall be for “S4” daytime permit parking and the permit shall be valid for both Lot 116 as well at S4 on-street permit parking areas in the vicinity of Fenwick High School as established by the Village.
In the last agreement Fenwick requested additional parking spaces. At that time the Village had available spaces in Lot SB5 (South Blvd between Wesley and East Avenues) and was able to accommodate the request for the term of this agreement. The Village continues to have available spaces in Lot SB5 and is able to accommodate this request for the next year.
Alternatives
The Village Board could request staff negotiate different terms for the license agreement.
