Introduction
overview
The Village is required to enter into an agreement with the Baltimore & Ohio Chicago Terminal Railroad Company for the 2025 bridge repair project occurring over the railroad’s property. The agreement is required to allow for the current bridge repair project to proceed for the repair work on the Home, Oak Park, East, and Lombard Avenue bridges over I-290 and also includes Austin Boulevard for any future planned work.

Prior Board Action
The Board has taken the following prior actions:
• The Village Board approved a Contract with ERA-Valdivia Contractors, Inc. for Project No. 24-14, Bridge Rehabilitation Program, in an amount not to exceed $995,668 on March 11, 2025 (RES 25-170).
• The Village Board approved a Task Order for Professional Engineering Services with TranSystems Corporation for Design and Construction Engineering Services for the 2024 Bridge Repair Project, in an amount not to exceed $69,940 on July 31, 2023 (RES 23-236).
Background
In March, the Village approved a contract with ERA-Valdivia to repair the bridges over I-290 on Home, Oak Park, East, and Lombard Avenues. These bridges span CSX Transportation's right of way along the south side of the I-290 ditch. This construction agreement with the Baltimore & Ohio Chicago Terminal Railroad Company (owner of CSX Transportation) is required so that the Village’s contractor can access CSX property to do the bridge repair work. The construction agreement also includes the Austin Boulevard bridge over I-290, which is not currently planned for repair work.
The agreement requires the Village to pay the railroad’s costs for railroad flaggers or any other work required by the railroad for the Village’s construction project. The Village previously entered into a Preliminary Engineering Agreement with the railroad for their plan reviews and permitting fees. The total estimated amount of the Construction agreement is $63,494, which includes $41,494 for the construction related costs and $22,000 for the previously paid Preliminary Engineering Agreement. Work on the bridge repair project is anticipated to start in late summer following final IDOT and railroad permitting coordination.
Timing Considerations
Adoption of the Resolution at this time will allow for the contractor to complete construction in the desired timeframe.
Budget Impact
There is $3,212,477 available for this agreement in the FY 2025 Budget in the Capital Improvement Fund, Public Works - Engineering, for Local Street Construction account no. 3095-43780-101-570951.
The Village will pay these estimated costs upfront and will be reimbursed any remaining balance by the railroad for any unused funds, which has historically been the case.
