Background

The Village of Oak Park currently has established authority under Chapter 15 Article 10 of the Village Code to immobilize and tow vehicles for unpaid parking violations. These enforcement tools serve as part of the Village’s broader parking compliance framework.

On January 1, 2025, parking enforcement responsibilities transitioned from the Police Department to the Development Services Department, under the Parking and Mobility Services Division. As a result, there is a need to ensure that the Village Code clearly reflects this operational structure and provides appropriate administrative authority for enforcement actions related to parking violations, parking citations, and adjudication matters.

The proposed amendments do not introduce new enforcement authority. Instead, they clarify procedures and roles of enforcement actions to ensure a more consistent and transparent approach. The amendments establish that the Parking and Mobility Services Division is authorized to initiate vehicle immobilization for qualifying parking violations, unpaid citations, and adjudication outcomes, while also clearly distinguishing these administrative enforcement actions from police-authorized tows related to public safety or other non-parking matters.

Additionally, the amendments reinforce the relationship between adjudication outcomes and enforcement eligibility and establish a more structured progression of enforcement actions. These changes are intended to improve compliance outcomes, reduce ambiguity in enforcement practices, and ensure that enforcement actions are applied consistently and in accordance with established administrative processes. This clarification ensures that enforcement authority is aligned with current operational responsibilities and supports efficient administration of the Village’s parking compliance program.

Staff Recommendation

Staff recommends approval of the proposed amendments to clarify and align vehicle immobilization and towing authority with administrative adjudication processes and current enforcement practices.

Advantages:

The proposed amendments improve clarity and consistency in enforcement procedures, reducing ambiguity in how immobilization and towing actions are applied.

The amendments align enforcement actions with administrative adjudication processes, creating a more structured and predictable compliance framework.

Disadvantages:

The proposed amendments may require minor staff training and internal process adjustments to support consistent implementation.

There may be a short transition period while staff adjust to the clarified processes.

Alternatives

Alternative 1:

The Board can reject the proposed ordinance amendments.

Advantages:

Maintains current Village Code language without changes.

Disadvantages:

Maintains current procedures, which may not fully support consistent and streamlined enforcement practices.

This process would remain with the Police Department, which no longer oversees this operation.
