Regular Village Board meetings are typically held at 7:00 p.m., the first three Tuesdays of each month in Council Chambers of Village Hall (room 201), 123 Madison St. When a Regular Meeting falls on a holiday, the meeting typically is held the following night. Pursuant to Sections 3.1 (Summary Use Matrix) and 4.5.2 H (Day-Care Centers) of the Village's Zoning Ordinance, a special use permit is required to operate a duly licensed day-care center in the C-Commercial District.

Background
The proposed location is tenant space located in a strip mall at the northwest corner of Lake Street and Lombard Street. As stated above, the property is located in a C-Commercial District which requires a special use permit pursuant to Section 3.1 (Summary Use Matrix) and Section 4.5.2 H (Day-Care Centers) of the Village's Zoning Ordinance to operate a duly licensed day-care center.
 
According to the Applicant, Oak Leaf Academy, LLC. is a premier preschool, which will provide education and care for children ages six weeks to six years between the hours of 7:00 a.m. to 6:00 p.m. Monday-Friday (except on holidays and teacher in-service days). The Applicants plan to offer 2, 3, and 5 day programs to families served by center.  The Applicant will operate with four classrooms, and the application indicates that there are four leased, on-site parking spaces available in front of the center, meeting the Zoning Ordinance's requirement for on-site parking for the proposal. At capacity, Oak Leaf Academy may hire approximately twelve (12) employees and enroll a maximum of 67 children daily based on the size of the space.
 
Alternatives
The Village Board may refer this application to any appointed or elected commission or committee, including but not limited to the Zoning Board of Appeals, for the purpose of holding a public hearing thereon pursuant to Section 2.2.5 of the Zoning Ordinance.
 
Previous Board Action
This will be the third location in Oak Park that the Applicant has sought for a special use permit to operate a day-care center. The first location was 149-155 S. Oak Park Avenue which was approved by the Village Board on October 3, 2011, but final negotiations with the property owner did not lead to a lease. In November 2012, the Applicant sought a second location at 206-208 S. Marion Street, which was not approved by the Village Board. The Applicant now seeks a special use permit for the tenant space at 200 Lake Street to operate Oak Leaf Academy.
To this end, on February 23, 2015, JoAnn Gantar and Melissa Veatch, on behalf of Oak Leaf Academy LLC., filed an application pursuant to Section 3.1 (Summary Use Matrix) and Section 4.5.2 H (Day-Care Centers) of the Zoning Ordinance requesting the issuance of a special use permit to operate  a day-care center at 200 Lake Street.

Anticipated Future Actions/Commitments
Following the hearing, the Zoning Board of Appeals will transmit to the Village Board a written report of its findings as to compliance of the proposed special use with the standards set forth in Section 2.2.3 (D) (Standards) and providing its recommendation.

Zoning and land use matters are unique to Village government within the corporate limits of Oak Park and therefore, intergovernmental cooperation opportunities do not exist.
