Overview
This Ordinance proposes to increase the fees charged for refuse, recycling and yardwaste collection and disposal. These services are provided by Waste Management to owners of residential property containing one to five units as well as Oak Park Institutional Facilities. These new rates reflect the charges for collection per the new contract with Waste Mangement and for disposal at the West Cook County Solid Waste Agency’s Regional Disposal Project. Background
The following are the proposed changes to the FY2019 Refuse Rate Ordinance:

1. The monthly refuse rate includes charges for:
a) Refuse Collection
b) Disposal Cost (a separate cost from Waste Management’s fees)
c) Village Administrative costs
d) Leaf pick up program
e) Alley Improvement fee
2. The rates for Waste Management’s services are increased by 2.5% per the agreement. See attached notice.
3. Refuse cart rates for the 96 gallon toter service are proposed to increase 3% to $27.51/month to keep up with Waste Management’s increase and Village administrative costs. The fee charged to residents covers the cost for this service.
4. Refuse rates for the 64 gallon toter service are proposed to increase 6% to $25.00/month. This would be the first year since providing the 64 gallon toter service option that the user fee will cover the cost of the service.
5. The Compost cart rate is proposed to remain the same at $14.85/month in an effort to continue to promote this service. In addition, it is proposed to keep the same Green Rate which provides a “first three months free” incentive for first time users when agreeing to at least 12 months of service. The fee charged by Waste Management is $15.15/month so this would be subsidized by $0.30 per unit per month. Through September 2018, 265 new Composter service users have signed up. Based on the current number of participants of 1546, the estimate of cost to the Village for this incentive is approximately $5,600.00 for FY2019.
6. Both Yard Waste and Refuse stickers are proposed to be increase to $3.00 per sticker each. This rate is suggested to encourage the participation in the Composting program. Approximately 5,000 yard waste and 22,000 refuse stickers are sold annually.

7. Section 20-7-20, Payments to Avoid Prosecution, fines have been increased from $25.00 to $125.00 to encourage property owners to comply with the Ordinance. The defendant has the option to either pay the $125.00 within 10 Business days of receipt or appear in adjudication court. The majority of citations issued are in response to overfilled dumpsters which has an average cost of $100.00 to be serviced by a waste hauler. The fine amount has not been increased since 1990. (See attached memo regading this updated section)
8. The invoicing for the 66 Institutional users is proposed to be completed by Waste Management. By doing so, rates will be those charged by Waste Management and not include any Village administrative costs. Rates will increase only 2.0% from last year. Waste Management will charge a nominal administrative fee of $6.50 per account for billing. The administrative fee will be waived if institutional users agree to sign up for Autopay. The Ordinance also includes a resolution outlining remedies for uncollected funds.
9. Currently, the Village’s residential (five units or less) and institutional waste hauling customers incur a monthly alley improvement fee in their refuse bill. For consistency, the alley improvement fee is also being proposed forresidential units with six or more units and commercial businesses. A monthly alley improvement fee of five dollars ($5.00) will be assessed through water billing. This section is included in Section 26-2-2, “meter Charges”, of the Village Code.

The Board can delay action to gain additional information.
Previous Board Action
Fees for refuse, recycling and yardwaste collection and diposal were last increased at the Village Board meeting on November 20, 2017. On September 19, 2016 the Village Board approved a new five year agreement with Waste Management for collection and disposal.

Anticipated Future Actions/Commitments
Annually staff makes a recommendation to the Village Board during the budget process in connection with the Waste Management contract.
Intergovernmental Cooperation Opportunities
Oak Park Institutional facilities (Park District, Schools, Religious Insitutions and various other Village non profit agencies) are able to take advantage of these rates if they elect to.
