Overview
In February 2021, the Village entered into an agreement with H&H Electric Co. to assist the Village in emergency street lighting repair in the amount of $15,000.00. The number of emergency repairs has exceeded estimates and the current agreement and first amendment do not contain sufficient funding to complete necessary emergency repairs. Staff request a second amendment to increase the not to exceed amount of the contract to $38,000.00.

Fiscal Impact
The FY 2021 General Fund budget, account No. 1001-43720-751-530660 ($45,000.00) provides for Emergency Contractual Street Light Repair Services. The account has recently been supplemented with $3,000.00 in funds from the Street Light Recovered Damages Account No. 1001-43720-101-441475. There is currently $13,000.00 in unencumbered funds available in the account to cover this increase.
Background
The Public Works Department typically makes in-house repairs and upgrades to the street lighting and traffic signal systems. When in-house staff is unavailable or lacks the necessary equipment to perform emergency repairs or upgrades, an outside contractor is utilized to do the work.
On February 2, 2021, the Village entered into an Independent Contractor Agreement with H&H Electric Co. for Emergency Contractor Services for street lighting repair and replacement in 2021 in the amount not to exceed $15,000.00.
As a result of the availability of additional unencumbered funds in the Emergency Contractual Street Light Repair Services account and additional recovered damages funds added to the account the agreement with H&H was increased for a total of $25,000.00 on July 7, 2021. This allowed for additional repairs to be made this year.
Staff is requesting the agreement with H&H be amended again to complete additional work. Just recently in October a street light pole was damaged. Staff is hopeful this amendment will be sufficient to cover the cost of the street light pole replacement and any needed repairs for the remainder of Fiscal Year 2021.

The Board can delay action to gain additional information.
Previous Board Action
The Village Board approved initial funding for this contractor for this work previously in past years and has approved agreement renewals for this type of work.

It is possible that the Public Works Department may be recommending another amendment of this type to the Village Board depending on the number and expense of incidences involving the street lighting system.
