It is requested that the Village Board authorize the execution of a settlement agreement in Workers’ Compensation Case Number 25 WC 03873.

Recommended Action

Authorize the execution of the Agreement.

Prior Board Action

The scope of the potential settlement and authority to negotiate the settlement was previously communicated via confidential memorandum to all Trustees, and Trustees were invited to raise any questions or concerns with staff, with the expectation that if no concerns were raised, this matter would appear on a future consent agenda.

Background

The agreement in this case sets forth the settlement terms pursuant to the parameters outlined in the confidential memorandum to the Board dated August 13, 2026.

Timing Considerations

This agreement is fully negotiated, and approval of the agreement allows the case to be closed at the Illinois Workers’ Compensation Commission.

Financial Impact

The total amount of the settlement is paid out of the Village’s self-insured retention fund.

Operations Impact

Authorizing the agreement and closing this file will reduce the time spent on the matter by in-house legal staff and outside counsel.

Staff Recommendation

Authorize the execution of the settlement agreement.

Advantages:

                     The settlement represents a savings over anticipated trial exposure, closes the file, and eliminates ongoing medical expenses. 

 

Disadvantages:

                     There are no disadvantages to the recommendation.

Alternatives

Alternative 1:

The Board can elect to decline to authorize the execution of the settlement agreement.

Advantages:

                     There are no advantages to this option.

Disadvantages:

                     Declining the agreement may result in an increased cost of time spent by outside counsel.

                     The Village may face additional liability and medical exposure.
