Temporary construction easements are necessary at 805 North Lombard Avenue and 850 Clinton Avenue in order to lower and replace private sidewalks to allow for replacing the public sidewalk corner ramps so they are compliant with the Americans with Disabilities Act requirements. This Resolution authorizes the Village to acquire the required easements and authorizes the Village Manager to execute the associated documents for obtaining these easements.

Background
The 26-2 Resurfacing of Various Streets Project includes upgrading corner sidewalk ramps at many locations so that they are compliant with the Americans with Disabilities Act's (ADA) requirements. This work sometimes requires lowering the public sidewalk so that the ramps do not exceed the maximum slope of 1 inch per foot. At two locations, the work to lower the public sidewalk necessitates the lowering and replacing of the private sidewalk. The temporary construction easements allow for the Village to replace private property sidewalk at the new elevations so that the public sidewalk ramps can meet ADA requirements.
The Village has been working with the property owner to secure these easements. The easements are being donated to the Village at no cost but obligate the Village to remove, replace, and restore impacted private property sidewalks and landscaping. The estimated cost of this work is $2,140 and is being paid for as part of the previously approved Resurfacing of Various Streets Project.
