Background
Tivoli Enterprises, Inc., DBA Lake Theatre ("Tivoli") seeks the creation of a new Class D-18 Movie Theatre Liquor License Classification and has applied for the issuance of a Class D-18 liquor license. Tivoli operates a movie theatre at 1022 Lake Street in the Village. Tivoli maintains ten (10) liquor licenses in various other jurisdictions in the Chicagoland region, nine (9) of which are movie theatres pursuant to movie theatre liquor license classifications that have been created by these jurisdictions. Such jurisdictions include the municipalities of Downers Grove, Elk Grove Village, La Grange and North Riverside.
The proposed ordinance would allow the sale of alcoholic beverages to movie theatre patrons one (1) hour prior to the showing of a film on a given day and alcoholic liquors would be permitted to be sold until 12:00 a.m. Alcoholic liquors would be sold from a service bar without seats within the theatre and patrons would return to their seats with their beverages.
