Pursuant to Sections 3.1 (Summary Use Matrix) and 4.5.2 H (Day-Care Centers) of the Village's Zoning Ordinance, a special use permit is required to operate a duly licensed day-care center in the C-Commercial District.

Background
The proposed location is tenant space located in a strip mall at the northwest corner of Lake Street and Lombard Street. As stated above, the property is located in a C-Commercial District which requires a special use permit pursuant to Section 3.1 (Summary Use Matrix) and Section 4.5.2 H (Day-Care Centers) of the Village's Zoning Ordinance to operate a duly licensed day-care center.
According to the Applicant, Oak Leaf Academy, LLC. is a premier preschool, which will provide education and care for children ages six weeks to six years between the hours of 7:00 a.m. to 6:00 p.m. Monday-Friday (except on holidays and teacher in-service days). The Applicants plan to offer 2, 3, and 5 day programs to families served by center. The Applicant will operate with four classrooms, and the application indicates that there are four leased, on-site parking spaces available in front of the center, meeting the Zoning Ordinance's requirement for on-site parking for the proposal. At capacity, Oak Leaf Academy may hire approximately twelve (12) employees and enroll a maximum of 67 children daily based on the size of the space.
