Overview
Overview
The developer, 717 South Boulevard, LLC, seeks approval of an easement agreement for overhanging residential balconies on the approved building at 715-717 South Boulevard. The building with the subject balconies was approved as a planned development in 2017. The South Boulevard facing balconies will overhang the right of way two (2) feet and five (5) feet over the alley to the rear of the building.

Background
The Planned Development is a five (5) story building with 14 residential units, a small commercial space on the first floor and 20 interior parking spaces. The front of the building facing South Boulevard will have three balconies (one per floors 2-4) that project two (2) feet over the front lot line - with the lowest balcony being 14.5 feet above grade. The rear of the building facing the alley to the south will have six (6) balconies (two per floors 2-4) that project five (5) feet over the rear lot line - with the lowest balcony being 14.5 feet above grade. This project was reviewed and recommended for approval by the Plan Commission in January 2017. A building permit application is currently under review by the Village. The Village Attorney and Village Engineer have also reviewed and approved the submitted agreement.

Alternatives
The Board could choose to deny the easement. However, this would necessitate a re-design of the building and possible review by the Plan Commission.
