Background
L’Alberello, Inc., DBA Anfora (“Anfora”) a seeks the creation of a new Class C-8 Boutique Liquor License Classification and the issuance of a new Class C-8 Boutique liquor license for an Italian focused wine store named Anfora at 128 South Marion Street. In addition to the sale of packaged wine and the incidental sale of other alcoholic liquors, Anfora seeks a license to allow tasting and sampling of wine in connection with small group wine education classes.
The ordinance creates a specific license class (C-8), with the following conditions:
The location must be 1300 square feet or less and be located in the “Central Business Area.”The “Central Business Area” is defined in Chapter 3 (“Alcoholic Liquor Dealers”) of the Village Code as the area between Forest and Harlem Avenue from North Boulevard to Ontario Street; on Oak Park Avenue from Ontario Street to Pleasant Street; on Lake Street from Euclid Avenue to Forest Avenue; and between Home and Harlem Avenues, from Pleasant Street to South Boulevard.
A licensee will be permitted to sell wine in the original package and for consumption on the premises in serving sizes of no more than six (6) ounces by the glass. The sale of other alcoholic liquors will be limited to no more than five perent (5%) of a licensee’s overall sales volume. The service of wine for on site consumption will be permitted from 11:00 a.m. to 10:00 p.m. A licensee shall be permitted to provide a lounge area with seating for no more than fifteen (15) persons, not including outdoor seating. No bar will be permitted. Tasting and sampling of wine will be permitted in connection with wine classes which Anfora plans to hold in the seating area inside the premises. Customers will be permitted to provide their own food and a licensee may provide prepackaged snacks. All staff will be required to be BASSET trained.
At its meeting of August 27, 2019, the Liquor Control Review Board (“LCRB”) recommended adoption of the new classification by a vote of five (5) in favor and none (0) against. The LCRB also found that Anfora met all of the applicable proposed requirements for the issuance of a C-8 license and recommended by a vote of five (5) in favor and none (0) against that the license be issued by the Local Liquor Control Commissioner. Prior to the issuance of the license, the Village Code must be amended to include Anfora as a C-8 licensee.
