Regular Village Board meetings are typically held at 7:00 p.m., the first three Tuesdays of each month in Council Chambers of Village Hall (room 201), 123 Madison St. When a Regular Meeting falls on a holiday, the meeting typically is held the following night. Overview
Overview
There is an existing vault under the sidewalks in front of the building at 1144 Lake Street. The property owner requests an agreement to memorialize the existing sidewalk vaults in order to provide the sidewalk easement needed to construct the Lake Street Streetscape Project. The Right-of-Way Encroachment License and Covenant Agreement allows for the sidewalk vault to remain and defines terms and conditions for maintenance and insurance requirements.

Fiscal Impact
There is no fiscal impact to the Right-of-Way Encroachment License and Covenant Agreement.

Background
There is existing basement space for the 1144 Lake Street building, formerly the Marshal Fields Building), which extends under the sidewalk. These underground spaces which extend beyond the building's footprint are referred to as vaults. The basement extends to roughly the edge of the sidewalk along Harlem and roughly twelve feet into the sidewalk area on Lake Street. Sidewalk vaults are currently administered under Village Code for Streets and Sidewalks Underground Construction and Use, Chapter 22 Article 6.

In order to secure a requested temporary construction easement with the property owner for replacing the sidewalks along Lake Street and replacing the corner sidewalk ramp at Lake Street and Harlem Avenue, the owner is requesting the Village enter into an agreement to allow for the existing sidewalk vault to exist in the public right of way. The agreement is required per Village Code 22-6-5 for all vaulted spaces.
