Overview
The Village previously entered into an agreement with the Baltimore & Ohio Terminal Railroad Company for the 2018 bridge rehabilitation project occurring over the railroad's property. The amendment to the agreement is required to extend the termination date of the agreement to allow for the current bridge rehabilitation project to proceed for the repair work on the East Avenue Bridge over the railroad property and to also include Lombard Avenue for any future planned work.

Fiscal Impact
There is no fiscal impact to amending the agreement as the costs for railroad permits, reviews, and flagging have already been paid under the original agreement in 2018.
Background
In 2019 the Village approved a contract with Era-Valdivia Contractors for repairs to the Home Avenue and East Avenue bridges. Work on Home Avenue was completed in 2019 and the work on East Avenue will be completed this spring, pending railroad and IDOT permits. The Amendment to the Construction Agreement allows for the Village's contractor to access B&OCT's property to do the bridge repair work as well as for costs for railroad flaggers and plan review of the project.
Alternatives
The alternative to this recommendation could be to delay action to gain additional information.
Previous Board Action
At the November 5, 2018 regular meeting the Village Board approved a Construction Agreement with The Baltimore & Ohio Terminal Railroad Company for Construction of the Bridge Rehabilitation Project over the railroad's property in an amount not to exceed $35,162.
