Background
On May 23, 2020, the Illinois General Assembly passed House Bill 2682 which creates a new section 6-28.8 of the Illinois Liquor Control Act, 235 ILCS 6/6-28.8 to allow retail liquor licensees in the State of Illinois to sell mixed drinks for delivery and carry out subject to the restrictions contained in the new section. House Bill 2682 is attached and awaits Governor JB Pritzker’s signature. The Governor has indicated he will sign the bill. The new section was enacted to alleviate the economic ramifications on liquor license establishments in the State due to the outbreak of COVID-19 disease. The ordinance codifies this new statute as part of the Oak Park Village Code to allow for the sale of mixed drinks for delivery and carry out by Class B restaurant liquor licensees in the Village and is recommended for adoption by the Local Liquor Control Commissioner on an emergency basis.
