An Ordinance is hereby presented to reallocate $45,000 of funding in the FY20 budget to provide funding for jersey walls for additional on-street outdoor dining locations at three specific businesses within the Village and to provide funding for jersey walls that allow the continuation of all existing outdoor dining locations through September 10, September 30 or as late as October 31, 2020.

Adopt the Ordinance, reallocating an additional $45,000 to provide for the continuation of jersey wall rentals for outdoor dining locations to as late as October 31, 2020.

 

Fiscal Impact

On June 15, 2020, the Village Board approved Ord. 20-048, allocating $25,000 to fund the rental of jersey walls to be used to set-up outdoor dining locations (GL# 1001.46260.101.540668, Business District Outdoor Dining).

 

If the rental contracts are extended through October 31, 2020, an additional $45,000 will need to be reallocated in the FY20 Budget.

 

If the rental contracts are extended through September 30, 2020, an additional $29,000 would need to be reallocated in the FY20 Budget.

 

If the rental contracts are extended through September 10, 2020, an additional $20,000 would need to be reallocated in the FY20 Budget.

 

Regardless of which date the contracts are extended to (October 31, September 30 or September 10), funds will need to be reallocated to cover these unbudgeted expenses. A not-to-exceed amount of $45,000 will be reallocated from Public Works-Forestry Division External Support (GL# 1001.43800.741.530667) to Business District Outdoor Dining (GL# 1001.46260.101.540668). These funds were originally intended to be used for parkway tree stump removal and thus some of this tree stump removal work may need to be deferred.   

 

Background

Governor Pritzker announced on May 20, 2020 that Illinois restaurants will be allowed to open for outdoor dining as soon as May 29, 2020. On May 28, 2020, the Village Board adopted Ordinance 20-043, an Ordinance authorizing outdoor dining in the Village of Oak Park, adopting the guidelines issued by the Illinois Department of Commerce and Economic Opportunity for safe outdoor dining, and providing for the waiver of Village outdoor dining permit fees.

 

At the request of the businesses, Village staff intends to set-up on-street, outdoor dining spaces at the following additional locations:

 

1.                     Addis Café (818 S. Oak Park Ave.)

2.                     Mulata Kitchen & Coffee (136 N. Oak Park Ave.)

3.                     Robinson’s No. 1 Ribs (848 Madison St.)

 

Additionally, given the uncertainty of how long outdoor dining will be needed due to the COVID-19 public health emergency, staff is recommending that the FY20 budget be amended to provide funding for the continuation of all approved outdoor dining locations through as late as October 31, 2020. Current funding, approved by the Village Board on June 15th, provides for the rental of the jersey walls only through August 7 - 22, depending on the specific rental contract.

A complete list of all outdoor dining permits, both on-street and sidewalk based, approved to date (6.26.2020), is attached.

 

Below are the current on-street outdoor dining locations, including the new locations requested as part of this agenda item, by Business District. 

 

1.                     Harrison Street Business District

a.                     Diagonal parking spaces in front of Buzz Café and Mora Asian Fusion.

b.                     Alley space between 211 Harrison and 215 Harrison.

 

2.                     Hemingway Business District

a.                     Hunter Court alley.

b.                     Lake St., between Euclid and Oak Park Ave.

c.                     Parking spaces on the west side of Oak Park Ave., North of Pleasant Ave. to the parking lot entrance on 105 S. Oak Park Ave.

d.                     Parking spaces in front of Bricks Pizza and Oberweis.

e.                     On- Street on Lake in front of Mulata Kitchen 7 Coffee.

 

3.                     Downtown Oak Park

a.                     Westgate, between Marion St. and the circular drive in front of Wheel and Sprocket

b.                     Marion St., between Lake St. and North Blvd. on Thursday nights

 

4.                     Other Locations

a.                     Loading Zone on west side of Oak Park Ave., in front of Hemingway’s Bistro.

b.                     Parking spaces on south side of Van Buren St., adjacent to Kettlestrings Tavern.

c.                     Parking spaces on east side of Oak Park Ave., in front of Addis Café.

d.                     Parking spaces on north side of Madison St., in front of Robinsons No. 1 Ribs.

 

In addition to on-street outdoor dining locations, Development Customer Services has processed outdoor dining permits for sidewalk locations and other non-traditional spaces, such as private parking lots. Again, a complete list of all outdoor dining permits, approved to date, is attached.

 

Alternatives

Amend the FY 20 Budget to provide for the continuation of all outdoor on-street dining locations jersey wall rental contracts through only as late as September 10, 2020 or amend the FY 20 Budget to provide for the continuation of all outdoor dining locations jersey wall rental contracts through only as late as September 30, 2020.

 

Previous Board Action

On June 15, 2020, the Village Board approved Ordinance 20-048, amending the FY 20 budget to provide for the set-up of outdoor dining locations in several of the Village’s Business Districts.

 

On May 28, 2020, the Village Board adopted Ordinance 20-043, an Ordinance authorizing outdoor dining in the Village of Oak Park, adopting the guidelines issued by the Illinois Department of Commerce and Economic Opportunity for safe outdoor dining, and providing for the waiver of outdoor dining permit fees.

 

On March 13, 2020, the Village Board adopted a Resolution Declaring an Emergency Affecting Public Health due to the outbreak of the COVID-19 disease in the State of Illinois and this was extended thru June 1, 2020 by Ordinances 20-124 and 20-128. On March 18, 2020, the Village of Oak Park‘s Public Health Director issued a Shelter in Place Order for Oak Park residents and businesses.
