Background
The State of Illinois recently adopted certain amendments to the Illinois Liquor Control Act, 235 ILCS 5/1-1 et seq. pursuant to Public Act 101-541 to eliminate the citizenship requirement to obtain a State of Illinois liquor license and to eliminate certain criminal convictions from being considered to obtain a State license. Section 3-3-1 of the Oak Park Village Code currently contains a requirement that a liquor license applicant must be a United States citizen in order to obtain a liquor license and the draft ordinance eliminates this requirement in order for the Village Code to be consistent with state law. The ordinance also contains a new Section 3-3-2 that eliminates the criminal convictions contained in Public Act 101-541 from being considered as part of a Village liquor license application.
The draft ordinance was considered by the Liquor Control Review Board ("LCRB") at its September 9, 2021 special meeting, and the LCRB unanimously recommended that the Village Board adopt the ordinance.
