Regular Village Board meetings are typically held at 7:00 p.m., the first three Tuesdays of each month in Council Chambers of Village Hall (room 201), 123 Madison St. When a Regular Meeting falls on a holiday, the meeting typically is held the following night. In response to the COVID-19 pandemic, under the emergency declaration per Resolution 20-43, which expired on June 15, 2021, the Village Manager was authorized to enter into Temporary License Agreements to allow local restaurants to utilize parking spaces for outdoor dining without a fee.

 

The Village Manager executed a Temporary License Agreement with the Beer Shop that expired on July 1, 2021. Then on June 19, 2021, the Village Board approved Resolution 21-165 extending the Beer Shop’s utilization of parking spaces for outdoor dining, without a fee, through October 31, 2021.

 

Since the COVID-19 emergency is still present, this proposed resolution is asking to extend the Beer Shop’s utilization of three (3) parking spaces in Village Lot #10. The proposed extension of the Temporary License Agreement is being requested through Thursday, March 31, 2022.

Fiscal Impact

Due to the COVID-19 pandemic, the Village waived all outdoor license fees for the 2021 season. Utilization of the four spaces in Lot #10 has been a part of that fee waiver. This proposed resolution assumes that the waiver of Village outdoor dining fees extends through at least March 31, 2022. The “regular” outdoor dining season, by Village code, begins April 1st of each year. Therefore, if the Village Board decides to return to charging for outdoor dining in 2022, approval of this proposed resolution will not conflict with that potential decision.

The Beer Shop has had the free use of the three (3) public parking spaces in Public Lot #10 since February 24, 2021. Through October 31, 2021, the $20 per day parking space cost, as fixed by Village code, has resulted in a Village waiver of $4,980.00. If this proposed resolution is approved and a new temporary license agreement runs through March 31, 2022, the cumulative parking space fee waiver would total $8,000.00.

 

Background

During the spring of 2021, the Village worked with several restaurants to set up outdoor dining locations in Village-owned parking spaces. Due to the emergency declaration in effect at the time, the Village Manager was authorized to sign temporary license agreements. 

 

The original Temporary License Agreement with the Beer Shop expired on July 1, 2021, due to a pending sale of the business. The Temporary License Agreement, under a new owner, was extended to October 31, 2021, by the Village Boards approval of Resolution 21-165 on July 19, 2021. This new proposed resolution would extend the Temporary License Agreement for a second time, through March 31, 2022. Each of the Temporary License Agreements has waived the Village’s code required $20.00 per day charge for the daily use of parking spaces.  

 

Alternatives

Direct staff to look for an alternative location or ask the Beer Shop to remove the outdoor dining structure from Lot #10

Resolution 21-165 was approved by the Village Board on July 19, 2021. This July 19, 2021 resolution extended to October 31, 2021, a previous Temporary License Agreement, signed by the Village Manager under the authority of the 2020 emergency declaration.
