Regular Village Board meetings are typically held at 7:00 p.m., the first three Tuesdays of each month in Council Chambers of Village Hall (room 201), 123 Madison St. When a Regular Meeting falls on a holiday, the meeting typically is held the following night. The Village Board has approved the ability of Oak Park businesses to use on-street parking spaces and alleyways for outdoor dining during the 2022 season through November 30, 2022. The Village Board has waived all fees related to outdoor dining in 2022. Of the Oak Park businesses that are able to utilize on-street or alleyway spaces for dining, six (6) have submitted applications and signed temporary license agreements that, if approved, will allow the Village to install cement barricades in May to allow for the start of outdoor on-street/alley dining.

Fiscal Impact

With the Village Boards’ approval of Ordinance 22-16 on March 7, 2022, the Village has waived all fees associated with outdoor dining for the 2022 season for both on-sidewalk and on-street dining.

 

Background

Since the start of the Covid-19 emergency in 2020, the Village Board has worked to support local businesses use of public sidewalks and on-street parking spaces for outdoor dining. In addition, the Village Board has waived the fees associated with the use of these public spaces in 2020, 2021, and again this year in 2022.

 

In 2020, thirteen (13) businesses signed temporary license agreements and were approved for outdoor dining utilizing on-street parking spaces or alleyways. In 2021, twelve (12) businesses signed temporary license agreements and were approved for outdoor dining utilizing on-street parking spaces or alleyways. In both 2020 and 2021, the village manager was able to sign all of the temporary license agreements for on-street dining due to the order in place at that time.

 

This year, the Village communicated with all of the businesses who qualify for this type of dining and have utilized on-street or alleyway dining in the past. Six (6) of those businesses have indicated a desire to again utilize on-street dining. Those six businesses include Kettlestrings Tavern, Mora Asian Kitchen, Sagano Sushi, Scratch on Lake, New Pot Restaurant and Rare Bird Preserves. As in the past, all of these interested businesses have filled-out application forms, submitted insurance documents and signed Temporary License Agreements that can be executed upon approval of this agenda item. Copies of application forms, signed temporary license agreements and resolutions, for each of the six businesses, are attached.

 

Several restaurants that had utilized outdoor dining in the past like Saigon Pho and Oak Park Brewing Company have closed and are not in operation. The restaurants that will be replacing those entities (Rustico replacing Oak Park Brewing and Oak Park Waffles replacing Saignon Pho) have told the Village that they are not interested in on-street outdoor dining during the 2022 season. Both of these new restaurants intend to have on-sidewalk outdoor dining when they open for business. In addition, businesses like Brewpoint OP, a previous utilizer of on-street dining spaces, has decided to instead maximize on-sidewalk dining in order to free-up on-street parking spaces for their customers. The Villages Development Customer Services’ and Public Works Departments have worked together, in conjunction with businesses like Brewpoint OP, Rustico and others, to move planters and benches that have existed in-front-of restaurants to more appropriate locations so that these businesses can maximize space for on-sidewalk outdoor dining. 

 

In May, after the execution of the temporary license agreements, the DCS Department will work with the Village’s Public Works Department to put-in-place the Village owned cement barricades at each of the approved locations. The cement barricades were purchased in 2021 and there will be no need to acquire additional barricades. The DCS Department and Public Works have already begun the planning for the deployment of these barricades so that the process can be expedited, following approval. If additional businesses, who did not submit applications or signed temporary license agreements to the Village this past month, indicate a desire to participate in the on-street dining program, there applications will be reviewed and brought to the Village Board at a later date for consideration.
